Notice of selection for expropriation procedures
In preparation for the XXth. Winter Olympic Games, “Torino 2006” (the “Agency”), located at 16 Galleria San Federico in Turin, Italy, Tel. +39 011 522 1233, Fax +39 011 522 1214, will assign responsibility for the performance of predetermined activities for the purchase of real estate property or of rights related to properties through expropriation procedures for the execution of public works or for public utility.
Interested parties may submit their candidature by filling-out an application (and affixing a € 10.33 tax stamp). To this document must be attached a photocopy of a personal identification document. “Attachment A” and the application must be placed in a sealed envelope addressed to the “Agency”, 2nd Floor, 16 Galleria San Federico 10121 Turin, Italy.
It can be sent through the Italian post office or directly via the pre-paid “priority courier” rate and postmarked by the post office. The envelope must bear the following statement: “Turin 2006 Winter Olympics Assignments concerning expropriation procedures” (“Olimpiadi invernali Torino 2006 Incarichi inerenti le procedure espropriative”). Interested parties must submit only the above-referenced application along with completed forms “A” and “B” – no other documents are permitted. The Agency will use said lists to select the candidates to whom assignments for the 2 January 2003 – 31 December 2005 period will be conferred and will periodically publish a notice of said conferment.
The amount to be paid will be less than € 30,000.00, excluding social security and other taxes. This notice does not initiate any competitive tender procedures of any kind, nor will a ranked list of any kind be prepared. The Agency is not bound in any way to specific procedures with regard to assignments.

Notice of contractor selection for planning
NOTICE OF CONTRACTOR SELECTION FOR PLANNING FOR AMOUNTS LESS THAN 100,000 EURO EX ART. 17, PARAGRAPH 12, LAW 109/94 AND SUBSEQUENT CHANGES
For all legal intents and purposes, the selection notice herein voids and substitutes the notice published in B.U.R. no. 47 on 20 November 2003.
1. Contracting centre: Agency for the preparation of the XXth. Winter Olympic Games “Torino 2006”, 16 Galleria San Federico – 10121 Turin, Italy, Tel. +39 011 522 1233, Fax +39 011 522 1214 (hereafter the “Agency”).
2. Job description: Selection will be made for the following assignment:
a) Drawing up the preliminary and final plans as per Ministerial Decree 471/99 and subsequent changes.
b) Preparation of initial guidelines and preparations for subsequent safety plans as per Art. 18, Paragraph 1, Subsection f) Decree (D.p.r.) 554/99 and subsequent changes.
c) Drawing up the executive plan as per Art. 16, Paragraph 5 Law 109/94 and subsequent changes and Art. 35 and sub-sections of Decree (D.p.r.) 554/99 and subsequent changes.
d) Drawing up the plans for the coordination of safety procedures during the planning phase as per Art. 4 Law 494/96 and subsequent changes.
For works to be carried out in the Lingotto area of Turin, within the area involved in the realization of the new stadium (“Nuovo Palasport”) for ice speed skating. The cost for this project is estimated at 1,600,000.00 Euro.
The activities regarding the executive planning and the coordination of safety procedures during the planning phase are optional, as per Art. 1331 c.c. The Agency reserves the right not to assign said optional activities to the assignee based on its indisputable decision powers until the definitive project is approved by the services conference.
3.Presumed amount to be paid: € 42,113.60 (including expenses, social security and other taxes).
4. Contract deadlines:
- Preliminary plan, initial guidelines and preparations for the carrying out of safety procedures: 30 consecutive calendar days from the date of completion of the environmental survey.
- Definitive project: 30 consecutive calendar days from communication to the contractor of preliminary project approval by the services conference.
- Executive project and coordination of safety procedures plan: 30 consecutive calendar days from communication to the project contractor of definitive project approval by the services conference.
5. Participating parties:
The following parties may participate:
a) For the services cited in Section 2, paragraphs a) and c), persons as per Art. 17, Paragraph 1, Subsections d), e), f), and g) Law 109/94 and subsequent changes.
b) For the services cited in Section 2, paragraphs b) and d), persons fulfilling the requirements listed in Art. 10 or Art. 19 of Law Decree 494/96 and subsequent changes.
Independent of the corporate status of the party to whom the project is assigned, the services citied in paragraph a) above must be performed by professionals registered by legally representative professional associations. They are personally responsible and nominally indicated upon presentation of his/her candidacy. Given the respective indicated professional qualifications, the services referred to in paragraph b) above must be performed by persons in possession of the requisites indicated therein.
Notwithstanding Art. 7 of Law 143/49 and subsequent changes, in case of joint projects, payment for the project will be made in one tranche.
6. Candidacy:
Applicants must present their candidacy to the Agency for preparation of the XXth. Winter Olympic Games “Torino 2006”, 16 Galleria San Federico – 10121 Turin, Italy, by 12:00 p.m. on 16 December 2003. All late applications will be excluded. Along with the sender’s name and address, the submission packet must bear the following statement: “Candidacy regarding planning and safety coordination procedures, Lingotto area involved in the realization of the new ice speed skating arena” (“candidatura incarico progettazione e coordinamento sicurezza area Lingotto interessata alla realizzazione del Nuovo Palasport per il pattinaggio velocita’ su ghiaccio”) and must include:
- The application for participation prepared on legal document paper or authorised and signed by the applicant/s, accompanied by the documentation indicated in paragraphs a), b), c), d), e), f), g) and subsections 1, 2 and 3.
- the “brief résumé envelope” including the documentation indicated in paragraph h), subsections 1, 2 and 3.
Said packet must arrive at the Agency “Torino 2006” via the Italian post office or by direct candidate delivery or by third-person hand delivery.
The date of arrival and not the date of posting will be referred to with regard to the entry deadline.
7. Documentation required:
The application for participation must include:
a) The applicant’s general information (sole professional, group of associates, company of professionals, company of engineers, subject to Art. 10 or Art. 19 Law Decree 494/96 and subsequent changes, temporary grouping), address, telephone and fax numbers, and social security (INPS), workplace insurance (INAIL), architect’s fund (INARCASSA) codes and indicate the branch where the applicant is registered.
b) Applicant’s declaration of non-payment in these particular instances as per Art. 51, Paragraphs 1 and 2 of Decree (D.p.r.) 554/99 and subsequent changes.
c) For the services cited under paragraph 2 a) and c), a declaration of listing in the related professional registers and for the services cited under paragraph 2 b) and d) declaration of being in possession of the requirements referred to in Art. 10 or Art. 19 of Law Decree 494/96 and subsequent changes.
d) Statement by persons authorized by law not to pay in exclusion proceedings as per Art. 12, Paragraph 1, Subsections a), b), c), d), e), f) of Law Decree 157/95 and subsequent changes and to be in compliance with Art. 17 of Law 68/99.
e) Declaration of knowledge of all the general and particular circumstances which may influence the actual performance of the service, including the Art. 1331 c.c. option, and undertaking to provide the service described according to the law and regulations currently in force or that will be passed while the project referred to herein is underway.
f) Upon execution of the contract – should the candidate be assigned the project - acceptance to undertake to present a statement from an insurance company authorized to operate in the “general civil liability” field in the UE, which will include the commitment to issue a professional civil liability policy as per Art. 30, Paragraph 5 of Law 109/94 and subsequent changes and Art. 105 Decree (D.p.r.) 554/99 and subsequent changes, with specific reference to the executive plan and to the plan for the coordination of safety procedures in the works planning phase, with policy limits of at least 10% of the sum of the planned works, with coverage commencing the first day of work up to and including the date a provisional certificate of final inspection is issued.
g) For temporary groupings, indicate:
1) the person appointed as head of the group, the persons appointed as principals, and a statement, in case of assignment of the project, to undertake constitution of a group as per Art. 11 Decree (D. Lgs.) 157/95 and subsequent changes.
2) under Art. 51, Paragraph 5 of Decree (D.p.r.) 554/99 and subsequent changes, young professional authorized for less than five years from the publication of the notice herein to carry out his profession according to current norms - or the candidacy will be excluded from consideration.
3) in the case of contract assignment, the division of professional responsibilities.
h) A brief résumé of maximum 20 typewritten A4-sized pages, including:
1) a list of definitive planning projects, as per Ministerial Decree 471/99, carried out by the applicant from the time the same Ministerial Decree was issued up to the date of publication of the selection notice in the specific environmental investigations and reclamation sector, indicating the object, the nature of the assignment, the client, and the cost of the related works.
2) a list of executive planning projects as per Art. 16, Paragraph 5 of Law 109/94 and subsequent changes, carried out by the applicant over the decade preceding the date of publication of the selection notice regarding the following category and cases, as per Art. 14 of Law 143/49: VII a, indicating the object, the nature of the project, the client and the cost of the related works.
3) a list of the applicant’s professional qualifications and specializations, as well as those of any permanent employees.
In order to avoid exclusion, the documentation listed under letter h), sub-paragraphs 1, 2 and 3 must be included in an envelope (“brief résumé envelope”), sealed either with tape, a wax seal, a stamped seal or a signed seal.
The statements and brief résumés must bear the legible signature of each person involved, along with a photocopy of a personal identification document.
8. Method of assignment: Project assignment will be based on experience and professional ability and according to the project outline prepared by the Agency. When the aforementioned project reaches assignment, said project will be conferred as determined by the Agency’s General Manager. Remuneration will be determined as per Ministerial Decree 4.4.01. The amount to be paid for services rendered will be reduced by up to 20% as per Art. 4, Paragraph 12-suppl. of Law 155/89, by 2% for architect’s fund (Inarcassa). 20% for V.A.T. will be added. Applications will be evaluated by a specially appointed Technical Commission of experts nominated following the application presentation deadline. Publication of post-application information notices will proceed via the same means used for this notice.

10. Further information: Documentation including: Notice of selection, “Remuneration for services” and the Contract Outline will be sent via the Italian mail post office upon faxed request by any interested party, along with a photocopy of the receipt for payment of € 10.00 to Agenzia Torino 2006, account no. 000000040212 c/o Banca Nazionale del Lavoro – Turin branch, 40 Via XX Settembre, ABI 01005, CAB 01000, with the following payment description: “Selection for planning assignment as per Art. 17, Paragraph 12, Law 109/94 and subsequent changes – New Stadium in Turin: purchase of further documentation” (“selezione affidamento incarico di progettazione ex art. 17, comma 12, L. 109/94 e s.m.i. – Nuovo Palasport di Torino: acquisto documentazione complementare”). The documentation may also be picked up directly at the Agency’s Contracts and Tenders Office.
The Agency reserves the right to revoke or void the selection notice herein or not to confer the project contained therein, and will incur no liability related to any such decision, including as provided for under Art. 1337 c.c.
As provided for by Law 675/96 and subsequent changes, all personal information provided by applicants, mandatory for the purposes related to conferment of the project, will be handled by the Agency according to said law. Applicants may exercise their rights as provided by Art. 13 of said law.
Before drafting the contract, the Agency will verify the actual possession of the required technical ability as stated by the assignee applicant as per Art. 10, paragraph 1-qtr. Law 109/94 and subsequent changes, applied when compatible by means of a copy provided by the contractor of the certificates and/or contracts and/or assignments issued by clients with regard to the services carried out.
The Agency will further verify the satisfaction of ethical requirements, as declared by the assignee, through the relevant administrative authorities.
